    I WAS RECENTLY AT A BAR AFTER WORK WHICH MY BOSSES BOSS HAPPENED TO BE AT HE THREATEND MY WAGES BEING LOWERED FOR SOMTHING THAT HAD NOTHING TO DO WITH WORK. AND TOLD ME THAT WAS PERFECTLY LEGAL, I TOLD HIM HE IS DRUNK AND THIS ISNT THE PLACE TO DISCUSS ANYTHING ABOUT WORK, LET ALONE MY WAGES IN FRONT OF OTHER EMPLOYEES, HIS RESPONCE WAS HE CAN DO WHAT EVER HE WANTS BECAUSE HE IS THE BOSS.     My husband installs satellite TV. They make him sign papers each week saying he will not get on a ladder when it is raining, or drive down a road that is slick due to icy conditions. If he calls and says he cannot finish or drive to a job due to these conditions, they tell him to wait it out until it is over or do it anyway and that isn't their problem. It is a catch-22. They used to give him 2 jobs per day, plus about 2 hours of driving. They work 4 10 hour days. Now they are given 5-6 HARD jobs per day and are given 300-400 miles per day. They have manipulated the system to show they are doing less work (points per hour), b/c they are not counting drive time. He is exhausted and they expect him to work 6 a.m. until 12 midnight if needed AT people's homes! It is unsafe for him to be so physically and mentally exhausted to drive so far. Is there anything unlawful about any of this? The only "discrimination" they have shown was by taking his hat off in front of many younger employees and making a joke b/c he is balding. They do give him more work than some of the younger guys (b/c he is sweet and doesn't complain and is a fast, hard worker). They take advantage. Would this be age discrimination?

    my boss drinks on the job,I told him I would feel safer working on vehicles in the shop if he didnt drink at work. He must have been affended, because a few weeks later he took my company van from my home kept my tools and tool box,never paid me for my last week worked

    I work at a restaurant and my boss ask me to do some construction work which is not a part of my job at the restaurant. As I was told to fix the parking lot out side the restaurant I got seriously hurt my self. Right now I am not working for last 5 months and receiving WSIB and my health condition is still the same without any improvement. I am still getting the treatment. Can I sue my employeer for doing something by force which not part of my job.

    A drug addict lives on my bosses covered front porch, he's a very paranoid person. He has been arrested several times for drugs and gun crimes. One night he began ranting to me about how I had stolen his clothes and drugs, than completely unprovoked this guy puts a loaded 357 in my face, Than he hit me with the gun in the face needless to say I beat him to the ground. There was a witness to the whole ordeal, who watched me help him up and tell him I only did what I had to do and I was sorry that it had to happen. He apologized,I forgave him. For the next week everything was ok until he started his crap again. The boss is a good guy but knows this dude is nothing but trouble but feels for him because he has nowhere to go and is to far gone to turn his life around. So today he started on me because I breathed to hard as I walked through the porch. he began threatening me. I went outside he followed and swung two times at me, before the boss,interviened, saving his butt.Boss says I have to put up with it and ignore him or quit. Puzzled

    I work for a large glass mfg. co. and i'm the only black bob-tail driver, I have a class B lic. and the other guy's have cls. C lic. They were giving brand new trucks which just recently I found out that they are class B trucks. I checked the GVWR and it is 33000 way over the limit for a class C vehicle. Did they discriminat against me or not. SECOND 5 or so months ago I was out sick and could not work per doctors orders, when i got better the doctor put me on lite duty, so when i took the doctor's note to my employer my boss signed off on the back of stateing that they don't have any light duty for drivers. So i had to go home with out pay, and had to file for dissability. Now just two months after that another driver slipped and twisted his ankle and he was on light duty working in the office. I asked him what are you doing working in the office? your a driver, he told me that his doctor put him on light duty. That's all i needed to here their has to be a violation of something. Please tell me what can be done.

    I'm employed by small IT company for the last two years. the first year I was paied regulary. but this year I was not paied for 5 month. My boss always said "when the project is completed and when the client pays us we pay you!!". I believe the company is going to be bankrupt because it's so dependant on that one client who is not happy and would not pay. What should I do ? 1) Leave the company and find another job. that means my 5 month wages will never be paid. 2) Leave the company and sue them for the unpaid wages. 3) wait untill the company announce bankrupcy..     tuesday i told my boss that friday may be my last day of work for the company. Today is thursday and i still do not have positive conformation that friday will be my last day of work. I have not quit yet and did not give anything afferming my intent to leave the company yet to my boss or anyone else in the company. Om wednsday i had to leave work early due to my wife falling very sick at work and she had to leave work early to go to the doctor and several specialists. As soon as i found out what was going on with my wife I gathered my things and my shop 2way radio then headed for home. I gave the radio to a fellow employee and informed him of what had happend. that all happend on wed.. on thursday i showed up to work ontime and was informed that i was not allowed to work in the maintenance shop that i have been in for over 4 years anymore. after 4 hours of work that day on thursday i was informed that i have been suspended from work and i had to turn in my badge, key and time card. The reasoning for my suspention was that i failed to call my boss to notify him of what was going on with my wife before i left the jobsite. i have a 3 day suspention. In case of an emergency with family the boss is the last person on your mind to call. If i may not be possibly leaving there would not have been a problem. Does this violate the fmla act? if i have a case please email [email protected]

    Help! In the hotel industy where business are seaonal throught the year. It is usaully busy in the Spring and Fall, Slow in Winter and Summer of the your, it was like that for the past 30 years in the U.S. I work in the baquet depament, my title is banquet server. Early this year, my hotel revised it policy and force employee to sign, who don't sign will not be schedule for work. A few months after we signed the policy, out hotel demand employee to maintian 30 hours to maintain out health benifit. All employee can fulfill it dueing busy cycle seasons but impossible in slow season. New policy force employee to do cross work in other department or work professional that we didn't apply and train for to maintain 30 hours. At this point we reoke the policy due to duress?     I was the bar manager at a restaurant. The assistant gm wanted my job becuase he wanted the bonus i was getting. He spread lies about me and eventually got me demoted to bartender and he took over the bar. I tried my hardest to just work hard at my new position. Two weeks later he called me into the office and fired me. I asked for an explanation and he told me he couldn't tell me. Can he legally do that? I've never had a write up or verbal consuling for anything.

    I worked for a Video Network. The company co owner's persoanl assistant called me after work inviting me down to have a drink and dinner with her and some co workers. I declined I dont drink graciously. Multiple text messages and 2 phone calls later. She was at home inviting me to come over and have sexual relations with her, I declined again letting her know if I did not work with her I would see her but due to the fact we work together I do not feel that is a safe thing. I am sorry. From that day forward we did not speak at work, 3 weeks later her boss let me go before our christmas bonuses were due. He stated that he would rehire me on a freelance independant contractor basis. In the new year, I have waited for that phone call and was never givin the oppertunity. Ex-Coworkers of mine have informed me that the girl who I would not sleep with, stated that if I were to work for the company on any projects, she will not produce the peice and that they can find someone else.     I have been falsely accused of job performance too low and harassed and humilated at work by my boss. I have already proved to the Human resources that all aligations are false and that my boss has accused me because he doesn't like me as a non Vietnemse. First, they threatened to fire me based upon my job performance. But now they laid me off after I proved that my boss had wrongly accused me. Can I sue the company?

I've contacted HR and they said my case is solid, so, if I'm terminated I will pursue a wrongly termination case.     i worked at a day care and my kids attend the day care. my employer failded to inform me that they were going to charge me for my kids attending the daycare. they took money out of my check without my authorizion. the question do they have the right to take garnishments of my wages with out my written authorization? can i do something about that.

    help! I was let go from a dental office that i am working for June12. June 13,07 a pt died in the parking lot inside his vehicle.i work at the front office,pts wife came in and said She needs the dr., we had all just got back from lunch,i saw the dr. and i told her out loud that the pts wife wants to speak to you, she basically rolled her eyes at me and ignored me , i ran to her and said again that the pts wife needs to speak to you, so the the pts opened the door(where pts enter before they go to the room) and said dr i think my husband is dead, so then thats the time that she reacted and ran outside, next thing i did i dialed 911, and one of my coworker told me i will talk to them(911 operator) .Okay i was let go because of that insident that i did not show any urgency, when shes(mgr) is not even there..at this point the dr has not been talking to me for weeks, but she talks to everyone around me as if i dont exist. if i do have a case pls email me at [email protected]

    Please i am doing a job as security officer in a big building where a lot of customers work.i have to be on my own for 12 hrs for security there is no back up for my health if got emergency. one day i got sick and spent long nite with sickness and my employer only told me to arrange some thing in future but nothing done.i do not have breack time during my job hour because many of custormers remain on site and do not let me have some time off, even i can not go to toilet,if i go to toilet they call me back and i have to open the door for them if got some late they blame me.i am advised to say them apologise whenever i go to toilet etc but i think i have a right to go there but not suppose to say apologise,so i am disgusting my self in this way to apologise them without any my fault.i have to spend time in very cold environment at reception in winter, i complain many times to employer for this but nothing was done.i have reported my employer but nothing. i have to use Lifts in the building if get stuck nothing is there as alternatively for my safety.can i sue my employer or go on with vulnerable conditions.

    i was working as Distribution supervisor @ about 16/Hr for 5years. it was 2am to 11:30am shift. i took perantial leave for 31 weeks. during parential leave i was looking for other job that pay me about same. i sent my resume to a company refered by friend. i had an interview with operation manager for store manager position. operation manager told that once i become manager and run store, i will be paid 15/hr. than i had intrview with owner/director. i got hired for store manager, they sent me for 6 weeks training. during trainning company paid me 9/hr. after 2-3week passed of training, company hired other person for same store, same position, where only one required. this person was related to one of representative from franchise's head office. this person was paid 11/hr during training. after i passed exam for traning, company sent me to work for someone else in oshawa and at company's store in new market. i got paid same 9/hr for working at other store even i was promissed 15/hr + gas for oshawa store, witch company doesn't owne. when it's time for store to open i asked operation manager for my hourly rate, he said company will pay 11/hr and send you to diffrent location, than he will review my performance and will decide if can pay me 15/hr or not. i quite my previouse job after this company promissed me 15/hr. now i could not go tomy previouse job since position has been filled. it is been hard for me to work for 11/hr since i was promissed 15/hr. i told operation manager that i could not do this job and left saying i will not come as of tomorow. he said he will call me next day, but he did not and i did not call him or go to work. can some one please let me know where i stand? what are my rights? they do not want to pay promissed wage, since they have other person. now i am jobless with 4 kids. please reply to me by e-mail [email protected] thank you

    My boss is a very rude and errogant person in the company to almost everyone. He forced me to go to business trip and work in China for two weeks this year. In the first week, I have to work at least 12 hours a day without any overtime payment. What's more, the company has some issues breaking the code I believe, such as the un-regulated abuse of toxic chemicals and working in non-airconditioning room in hot summer.     I began working for a financial planner last February as a part-time computer operator. After only working for two days my employer offered me the position of sales assistant. I accepted. I had to sign a contract stating I would have to pay her $5,000 for my training if I did not stay employed there for one year. My problem begins here. My boss is a very agressive, intimidating and verbally abusive person. She is prejudice against African Ameicans (which I find extremely offensive). I found myself becoming ill very often as a result of the stress she inflicted upon me. I quit my job. She is now threatening to sue me for the $5,000.00 plus the cost of a training seminar out of town along with business expenses incurred during the trip. I do have witnesses to her abusive name calling and putting me down daily. I am contemplating filing a complaint with EEOC.     I am continuing the previous topic which posted before completion. They hired someone outside of the co. with no degree or experience in our system,or our processes. I have written every SOX procedure, dept. procedure and trained our whole dept. including the manager. We are of different race. I have recently been suspended due to the manager's lack of knowledge of a funds transfer function. Upon being suspended until the investigation is completed, I was called 2 hours later to assist them with the investigation because they don't know the system or the process. I refused. I was told that because I am suspended with pay that I have to assist them investigate me. The HR. director has advised me of this. He has also advised that I am not terminated, but the Credit Manager has advised the dept. that I am no longer with the co. and that she is going to start interviewing. I have received NO paperwork regarding any of this. I didn't even receive paperwork regarding the suspension. I am seeking legal action for all of these incidents. I was also written up for the fact that I missed too many days of work when they rushed me to the hospital from there which resulted in a hysterectomy. I requested access to work from home and was told no, but access was given to another worker who had gall bladder surgery. There was a difference in race. I was also offered a supervisor position 8 months ago. I was called in a meeting and advised in front of the dept. that my supervisor position was on a trial basis, but two other workers were being promoted to supervisors as well but theirs were definite. There is also difference in race. One of the Supervisors promoted can't read very well and makes daily errors in cash processing, credit & debit postings in which I have to correct.     My boss has worked me overtime for 3 months without paying me and now she is about to cut my hours. she thinks that hours need to average out to 40 a week...so one week i will get 35 the next i will work 45 and still only get paid for 40 and she doesnt offer benefits!

    Ok guys here is what you should do? Consult 2 completely different lawyers and listen to what they have to say bring proof if you can and tell them what you want at the end of the case. Do not tell anyone maybe your partner, etc but things under law should not be outspoken and sometimes may not even go to plan especially at your workplace not your boss when he gets his time and date for court jus wait to see the look on his face oh and never leave your workplace it will only anger your boss becuase if what he has done is highly racial,abusive discrimination and you have a little proof 89% you are going to win this case. look at me im running a business out of the money i won and im only 26.good luck

    I had worked at the same Co for over 15 yrs and even declined going through carpal tunnel surgery bc I did not want to miss work. I recently found out I have a hernia and declined surgery as well. I was wrongfully fired from my job and would like to know if it is too late to file worker's comp or maybe sue the Co bc of my job is that I got both Carpal tunnel and a hernia, I was a truck driver and mechanic. what should it do?

    I work part-time as a receptionist in a restaurant.The contracts haven't been provided for employees. Our wages are based on Service charge which is being divided between all staff. We have no access to it, and as a result we don't know how much of it we actually get,we get it every month in cash all taxed with no sign of any payslip.     I worked fulltime at a company as a driver for 7 years and one day my father had an aneurysm. He needed surgeory right away to save his life. I was told that his chances of survival was low. I was stuck at work that day, when i got the call from my sister's. I told my boss that i have to leave work because of a family emergency. My boss was only thinking of himself and for the company and said that i can not leave, as no one can replace me and my duties at the company. As i recall under the employment act that i am entitled to a 2 day absence w/o pay. And i didn't even get that. Needless to say, if my father would have died that day. There would be a law suite that i will Win....

    To anonymous from cvs First of all, is it a doctor that cvs is affiliated with, and if yes, get another opinion and explain to them the pain you're enduring, especially if it is making it difficult for you to work efficiently and comfortably. Then if something is discovered, find a lawyer whom you can talk to. Many lawyers will offer free consultations. What have you to lose?

    I work for a korean company. I am mexican america. The boss her is very prejudice agains other races that are not Korean!!!! and their is a lot of Nepotism in the office.     I returned from Maternity Leave and needed to take my 5 month old for his check up. I was advised the next day by the CFO that my immediate supervisor was having an issue with me taking my son to the Doctor and that he thinks that I get another job and that he would be happy to write a letter of reccomendation. I have never been written up or done anything to be fired. And I didn't understand why this was happening. I have received great reviews and bonunes. ANd there are other people at the other office who use their time to take their kids to doctors, etc. Why am I being singled out. I am the only assistant here in the office but if the other assistants get to take time for Dr. Appointments, etc. Why can't I? And why am I being asked to get another job when I do.

    I am being suspended from work for allegedly having a bad attitude with another division of our company. The claim is that, thru emails, I have belittled or been demanding of our other division. I have received 2 performance appraissels since taking over this job, One was meeting expectations and the other was exceeding expectations. I have given the highest honor in our company, An AllStar Award given to 8 people a quarter in a company with 25,000 employees. I was nominated for that award by someone in the division that I am apparently being unprofessional with. As the senior manager, I fill in for my boss when he is on vacation or in training. I have received nothing but accolades from my peers and superiors, until about three weeks ago when I unknowingly pointed out that my bosses boss, had screwed up. Since then, he has said very little to me and been very rude with his emails. He has asked my boss to write me up and suspened me. My boss felt that was unnecessary and just had a talk with me to explain the situation. 4 days later, my boss calls me into the office and says he is being forced to suspend me. I feel as if I am now being forced out of the company. The SOP for write-ups is a Verbal, then Written, then Final Written and then Termination. My boss is being forced to escalate this past the verbal and written and make it a final written. I cannot help but feel as though I am being pushed to look for another job as I do not want to be fired. What can I do?

    i have worked at my job for 2/12 yrs and now that i been harassed i told my employer to handle the situation and he took me off the schedule after i told him i would take legal force if he didnt handle the harassment situation and he said he wants me to resign gracefully and to keep my mouth shut he wont fire me cause he knows he will get in trouble for unsubmissonal cause i have never been written up or got in to any trouble but he took me off the schedule until i agree to shut up ablut the complaint too late already going to file the discrimination suet but never take any miss treatment from a employer they wanna play ball just play harder and go for a home run we are all grown adults so show them you can act like one too.

    Aug. 31 I got a call back from Subway, wanting me to come in for a couple hours as a tour of the job. I got there around 630 pm that day and stayed until about 15 min. before the store actually closed. while i was there they gave me a schedule for fri. and sun. for the next week. The owner never filled out new hire paperwork. They called back tues. telling me to come in to work on wed. i worked from 11am-5 pm. 30 min after i arrived home i get a call saying that i wasnt what they were looking for. While i was at work the owner told me that i wouldnt be paid for the "training" period Can he legally do this?

    I'm a Bartender, My boss forces us to discriminate against anyone who isnt straight or white. Makes us charge double for drinks ect.. If I don't she will find someone who will is what I'm told. She also mkes us run and collect money for her illegal gambling games. She counts our tips out at the end of the night. We don't get to count them at all, then she gives us what she says we made. We know she is skimming some but can't prove it.Thats just a few things that go on there. I want to quit but I am in fear without an education and a bad economy for servers. What can I do?

    My boss cut my hours saying she didn't have to keep me on and that i should be pleased she's offering me less hours, i couldn't do anything about it because i hadn't worked there a year, which is a silly rule if you ask me. She's now claiming i've taking more holidays than i actually have, and she hasn't paid me for the 2 weeks i just had because she says i wasn't due any. She's also saying the supervisor told me i wouldn't be getting paid (which isn't true) and that the supervisor told her i had taking an extra week which i haven't. Can i do anything to stop her treating me like this?

    I work for a large family owned department store where i am a customer service agent. recently my store manager has been verbaly abusing me and when i try to speak to her she says she does not want to talk about it or she threatens me not to get smart with her even though i am not. i don't even raise my voice i just want to defend myself against her abuse. how can i protect myself and defend myself at the same time without the fear of getting fired. also she has a history of verbal abuse of power. i am only one of a very long list of people who need this job but do not deserve the abuse. the last person who went over her head and complained was fired for "mystery reasoning".

    A couple months ago I found out that I was going to have a baby. I told my employer right away because I work in a nursing home. From that point on my life at work was hell. I was put on halls by myself and I wouldn't even get a break during my shift. When I told my employer about it nothing was done. I ended up sick three times. One time I had to call off work and two times I left work early and went to the emergency room and I always brought back an excuse from the docter. Then last wed. I woke-up with a fever and I couldn't swallow. I called my mid-wife and she wanted me to go to the E.R. I called my employer to tell them I wouldn't be in and the D.O.N proceed to tell me it was my 3rd call-off and I would be terminated. I tired to tell it was only my second she got very nasty and borderline verbally abusive over the phone. She had me so upset I felt I had to quit or get fired even through I was right. So I called back and told them I quit because I felt forced. I found out two days later that she knew it was not my 3rd call off and she still threatned me over the phone. I feel very discrimated aganist because I am pregnant. What can I legally do I relied on my income now I have no income.

    After working at my construction job for 4 years I acquired hernia. Being a gate welder at this job they expected you to lift 200 to three hundred pound gates with one helper in a fast paced and unsafe manner all day. I lifted one day and felt kinda like a pop in my stomach. I knew I would get screwed in the end but I reported it anyway. I was checked out by there work comp doctor and he acted like he couldnt feel it at first when it's very easy to feel and my personal doctor already told me what it was. Anyway I was told not to lift heavy which is 90% of the job. Very soon after I was fired. I believe this was do to my reporting this injury, costing them money, and making me a liability. Is there anything I can do about this? And if there is nothing I can do how do I atleast go about getting corrective surgery?

    Ex-boss had a past history of alcohol and drug abuse. I knew about it. She wanted to appear perfect and got rid of me. But other people in the company know anyways! Poor thing. She's still wallowing in her misery. I've moved on and I'm FREE!

    i wurk at the burger place very very hard. i flip da burgers very fast and make good fries too. i take no breaks but i like to eat dose nugget chickens while i work. so one day i flip the burgers while making fun of the color guy who cleans the floors and pinchin Julies behind. Even though she always tell me stop i know she really like it. and fur no reason at all my dummy boss tell me im fired for no reason. i yell at him at him and threw the burgers on the floor but he still woudl not listen. i even tell him i burn the place down and he still do not listen. if he were a good boss he would not fire me so the burgers would not be waste and the there no chance of the place buring down but he a dummy. can i sue for dummy boss firing me for no reason, i figure you must be able to sue a bad boss for making me mad. i hit myself with the burger flipper when throwing teh burgers it hit my head but missed my eye. can i sue for pain adn suffering? it really hurt

    I was giving a layoff notice by a fellow employee. Told by my supervisor to hurry up and get my work done so i could be laid off again.this occurred 3 days after I had informed the company(large corp.)that my doctor was sending me for m.r.i. on my knee and would likely need surgery on torn cartiledge. This company told me that since I started the man hours for my work have dropped over 200 hrs and that i would never have to look for work again. I have 1 verbal discipline in 5 yrs and no written disciplines. I get along with and can work with anyone at the plant with the exception of my fellow enginefitter and our supervisor. who has constantly told me to hurry up so he can lay me off again. My partner says to my boss that he refuses to work with me, eventhough any1 else who has said this is told to go home till they will. Also, the union doesn't know their own rules and the company seems to do what they want anyway. The union's regional rep. keeps telling me to accept the fact that the company doesn't want me anymore and for my families sake I should move on. All this after being laid off with illness twice and the company failing in duty to accomadate as well as refusing the benefits I pay 60.00 dollars a week for my supposed 20%. Pls, someone help. My family is going to lose everything because of what I think is personal dislike.

    I worked for a very small business. My boss refused to may me. He ended up spending my entire salary on a prostitute. I obviously quit. After I did, he spread very bad lies about me to other potential employers. This has made it very hard for me to find work.

    I have just started a warehouse job and only been there for a month & half. My boss there is always harassing me by telling me that I might not have a job anymore, or when I mess up he tells me that I am keeping him from his family and if I keep messing up that when I want a day off he is going to say no and make me sit down on a chair and stay there so that I wont be with my family.There was once that he even said that I should speak to a proffesional or someone because I had problems that were affecting my work. That I should tell them I have a good job and I'm not doing so well (I have no expierence in a warehouse) and what should I do (my boss knows I have no expierence).Some times he's even asked me that was he making a mistake by hiring me. In all honesty I've tried my hardest-my past employer once told me that if someone is doing a bad job that they couldn't fire if they were trying, but if the person knew what they were doing was bad or didnt care how they were working.Then the employer could fire them. Is that true? My boss even once said that I should run when I'm not at work so that I can have more energy because I move very slow. When I move faster then people that are there. Can I sue my employer for what I honestly believe is harrassment? Is this harrasment?

    Hello, I left my previous employer (a large bank) in good standing (gave a two weeks notice), and have been contacted multiple times about different positions. I have changed my references, submitted for positions with a blank profile and had my resume handed to them directly, even had my resume passed to different hiring managers all with the end result being the same; the hiring managers contact my previous manager (s) and I then receive a decline email for the position. The interviews all go well, then when it comes to the point of "contacting my references"; my references are never contacted, just previous management. My previous management holds a personal grudge against me. Is this fair? Should/can I sue? I am not only losing out on increased pay and benefits, but also lost my tenure.
